no, that's the whole slop.
it's one big gray area because they make it that way. this way, they can keep their cush job with benefits that the american public doesn't get - franking privileges, a 6 figure salary that, once you become an incumbent (90% incumbency rate, fyi), you get to keep that 6 figure salary and it becomes a retirement fund VERY easily, all of the benefits of having lobbyists lying at your feet, congress being able to vote themselves a pay raise, a freaking COLA (you don't need a damn cola if you're at a six-figure salary), etc.
remember that pretty much no congressman/woman tries to get a bit of legislation passed for the good of the people. it is simply what their constituency wants, and what their constituency wants, you better believe they sure as hell get it, lest the incumbent not get re-elected next year.
everyone hates congress, but everyone loooooves their congressman (generalization, but you know for the most part that it's true).
but, good god, the fact that YOU. You, American sitting at your desk/couch with laptop/internet cafe. YOUR SENATE has passed a bill at a 93% passing rate that allows the military to detain you indefinitely WITHOUT CHARGE, a DIRECT violation of the constitution.
then there are the lobbyist-driven bills (SOPA, anyone?)
